We help our clients understand and respond to the fact that their parenting time will be altered to at least some degree as a result of the divorce. Generally, there are three types of custody, including physical custody, sole custody and joint legal custody:

  1. Full custody with visitation rights for one parent. In this case, the noncustodial parent must generally pay child support.
  2. Joint legal custody. In this case, one parent has physical custody, but both parents participate in decisions concerning the children's education, medical care and recreational activities.
  3. Shared custody means that the parents share joint legal and physical custody. The physical custody split does not mean that the child must live with both parents equally.
  4. Questions abound concerning child support. In Michigan, a computer program is used to determine child support calculations or guidelines. Factors such as the income and expenses of each partner, tax exemptions, childcare costs, other support orders and other sources of income are all weighed.
  5. Couples who never married but have a child together may also legally seek child support determinations from the family law court.
