Unlike a drunk driving charge, where the burden of proof is on the state, a license restoration hearing requires you to prove that you are no longer a driving risk. Your lawyer must demonstrate that your substance abuse is no longer a problem and will not be a problem in the foreseeable future.
Get Your License Back
- For Hampel Law Center to represent you, we require three letters from people who are close to you, who have seen you in the past in social situations and who see you in the present in social situations. They must testify about how you have changed. We will present these as evidence on your behalf at the license restoration hearing.
- You will need to attend some addiction recovery program. If it is Alcoholics Anonymous (AA), you will need to go three times a week and provide proof of attendance (e.g., a sign-in sheet from the AA meeting).
- It is necessary to get an alcohol assessment with a credentialed counselor who can assess how likely you are to stay in recovery.
- You must testify about your own sobriety.
If you have been convicted of two or more DUIs, your license may be restored provisionally. You could be required to use an ignition interlock (guardian interlock) device, where you blow into a tube to test your blood for alcohol before the car will start.
